Blocking a Logo Copy for a Bakery Chain
A local competitor opened a point with an almost identical logo. Thanks to prior mark registration, we closed the case with one letter and a 4,200 PLN settlement.
The Chrupiący Zakątek bakery from Rzeszów faced the problem of a blatant copy of its brand. A competing point in the same neighborhood started using an almost identical font and color scheme, which misled customers.
The challenge
The bakery owner, Mr. Tomasz, noticed that customers started asking about a 'new point' that actually belonged to another company. The competition copied not only the name but also the characteristic graphic layout of the logo with an ear of grain. In the first 3 weeks, turnover at the point on Rejtana street fell by 14% because some people unknowingly bought from the competition, thinking it was the same chain. The case was difficult because the owner of the copy claimed that 'all bakeries have ears of grain in their logo' and didn't see a problem.
Our approach
We started with a quick evidence audit. Chrupiący Zakątek registered its trademark with us 3 years ago, which was crucial. We prepared a precise comparison of both marks, demonstrating 87% similarity in key visual elements. Instead of going straight to court, which takes ages in Polish conditions, we went for 'straight to the point.' We sent a pre-trial cease and desist demand, backed by hard numbers from the Patent Office. Our lawyer met personally with the owner of that point to explain the financial risks.
The solution
We prepared a settlement that left no room for maneuver. The competition had to take down the sign within 7 days and sign a commitment not to return to a similar name for the next 11 years. We also negotiated compensation of 4,200 PLN, which covered the costs of our intervention and losses resulting from customer confusion. The case was settled without court participation, saving Mr. Tomasz at least 18 months of stress.
Results
Thanks to hard evidence and quick reaction, the brand was secured, and the competition changed its visual identity to something completely different in less than two weeks.
